Local authorization for Cruize stop off in island is denied by the Municipality on Carnival days.

The municipality of Ilhabela, on the northern coast of Sao Paulo, Brazil, did not allow the passengers of the Cruise "MSC Sinfonia", visit the island in the days of Carnival. The reason that moved the administrative act of the Tourism Department, is overcrowding. According to the Secretary Djane Vitoriano "Ilhabela receives other three Cruises together that represent 11,315 passengers and 2,411 crew members - the island has  infrastructure to receive up to three Cruises a day."

The Cruise season in Ilhabela began in October. Until April will be 138 stops with  at least 300,000 passengers. According to a statement posted on the municipality's website, this measure is also supported by the rules of the Navy, responsible for waterway safety.

The Secretariat of Tourism is doing its job in a reasonable and balanced manner on respecting the public interest, as it is for the executive act within the municipal limits of reasonableness to ensure the welfare and local sustainability. There will always be clash of interests that need to be weighed. According to information published in the two sources of this matter,  the Secretary of Tourism of the city suggested a new date to the company that changed the script provided to the City. The ship will be sent to Sao Francisco do Sul (SC) and will  return to Ilhabela on March 11, 2011. In this sense occurred satisfaction of interests of both sides, with the only exception being observed carefully by the municipality, the question time. In other words, the Cruize stop off has been authorized, however on further date to avoid imminent risk of overcrowding.

The act administrative of the City by a broad view, according to Maria Sylvia, can be classified as "administrative act unilaterally, discretionary and precarious by which the administration (municipality) in particular provides the private use of public property, or the performance of material activity or the performance of an act that, without such consent, would be legally prohibited. (..) The authorization  involves all the assumptions on which the exercise of activity or practice of acts are prohibited by law in particular for reasons of public interest related to safety, health, economic or other reasons concerning the protection of the welfare state.
